Eligibility

What you need to qualify

There are no financial thresholds. Qualification is based entirely on your professional achievements. You must meet at least 3 of 10 USCIS criteria — and pass a final merits review confirming sustained national or international acclaim.

Step 1 — Threshold
Meet 3 of 10 criteria
You must satisfy at least three of the ten USCIS evidentiary criteria below with credible, documented evidence. Alternatively, a single major international award — Nobel Prize, Pulitzer, Olympic Medal — is sufficient on its own.
Step 2 — Final Merits
Sustained acclaim review
USCIS reviews all evidence holistically to confirm you have reached the very top of your field with sustained national or international acclaim. Meeting 3 criteria alone does not guarantee approval — quality of evidence matters as much as quantity.
01
Awards & Prizes
Nationally or internationally recognised prizes or awards for excellence. Evidence of the award's prestige, selectivity, and recognition level is key.
02
Elite Association Membership
Membership in associations requiring outstanding achievement as a condition of entry, judged by recognised national or international experts.
03
Published Media Coverage
Published material about you and your work in professional or major trade publications. Coverage must be about you — not just authored by you.
04
Judging Others' Work
Participation as a judge of the work of others — individually or on a panel — in the same or a related field of specialisation.
05
Original Contributions
Original scientific, scholarly, artistic, athletic, or business contributions of major significance. Evidence of impact on others is critical.
06
Scholarly Articles
Authorship of scholarly articles in professional or major trade publications demonstrating contribution and recognition in the field.
07
Artistic Exhibitions
Display of your work at artistic exhibitions or showcases. Applies to visual arts, design, architecture, and comparable creative fields.
08
Leading or Critical Role
Performance in a leading or critical role within distinguished organisations. Evidence must link your specific contributions to measurable outcomes.
09
High Salary or Remuneration
Command of a high salary significantly above peers in your field. Documented evidence of compensation relative to others is required.
10
Commercial Success in Performing Arts
Evidence of commercial successes shown by box office receipts, record sales, viewership, or other evidence of commercial impact.

FAQ

Common questions

Do I need a US employer or job offer? +
No. The EB-1A is a self-petition — no employer sponsor, no job offer, and no labour certification (PERM) required. You file entirely on the basis of your own achievements and your intent to continue working in your field in the US.
What counts as "sustained national or international acclaim"? +
USCIS looks for consistent, ongoing recognition over time — not a single achievement. A track record of awards, citations, media coverage, high-profile roles, or other recognition spread across multiple years. Acclaim that existed in the past but is no longer current at the time of filing will typically not satisfy this requirement.
Can I apply for EB-1A and EB-2 NIW at the same time? +
Yes — filing both simultaneously (known as "stacking") is often the smartest approach. Both are separate I-140 petitions with different standards. If one is approved before the other, you can proceed immediately. Filing in parallel is fully permitted by USCIS.
Is premium processing worth it? +
For applicants with strong, well-prepared petitions who need to plan a move quickly, premium processing is almost always worth it. It guarantees USCIS will issue a decision within approximately 15 business days. It does not guarantee approval — only speeds the review.
